APC Federal lawmaker drags Governor Fintiri to court over revocation of land title in Adamawa.

A member of the house of representative representing Yola North,Yola South and Girei Constituency, Hon.Abubakar Babazango alias “Abaza” has dragged the Adamawa state government before a high court in Yola contesting  revocation of his two hectares plot of land in the state.

Addressing the court when the case was brought up for mentioning last Monday, the legal counsel to Hon. Babazango, Barrister Desmond Adewale told the court that, the former owner of the land acquired it in 1976 while  the current title owner ( Hon.Abaza)  purchased the said land legally from his family and constantly pay ground rent until suddenly, the issue of revocation came up from the government.

Adewale said his client deem it fit to rush to court to seek redress accusing the Governor Fintiri’s led- government of trying by all means to forcefully take over the land from him noting that,the letter of revocation was served on a dead man,whom has already seized to be the owner of such property.

Adewale advanced that,the late owner of the land,Alhaji Jika Paris Jambubu seized to be owner of the property because his heirs sold the landed property to Hon.Baba Zango and had taken full possession as provided by laws of the land.

He accused the government of backdating the letter of revocation to make the Court order restraining them from using the land useless praying to court to ensure Justice to his client.

However, in a counter motion, the counsel standing in for the state government (Adamawa),Barrister Abayomi Akamode told the court that, the Governor has a right to revoke the land for overriding public interest.

Abayomi Citing provision of section 28 of the Land Use Act. said, the public interest is far above the interest of an individual referring to Him. Babazango.

He faulted the Plaintiff (Babazango) for not giving a pre-action notice of thirty days to the Governor as the Land use act provided.

He said his appearance in Court was to challenge the action of the plaintiff who did not give the pre-action notice of thirty days before he could commence any action to the Governor.

“We are challenging the competence of the action itself asking that the Court should strike out this suit because they have not given out the necessary pre-action notice and when you have not done so the court has no jurisdiction to entertain the case.” Abayomi

After hearing both parties through their legal representations, presiding judge of the court, Justice Ahmed Isah adjourned the case to 26th February 2024 for ruling.

Fielding questions from journalists at the court premises, Barrister Adewale described the revocation as “illegal and political” explaining that it all started when Governor Fintiri refused to released the famous Ribadu Square for the opposition APC for it’s presidential and Governorship campaigns in 2023.

But Hon. Babazango out magnanimity offered the APC his vast and used to host such big occasion of campaigns.A development that hurt the government

“Whoever that’s telling you that the Land was revoked for the public interest is telling you a pure lie. The land was revoked because he gave it to Tinubu and Binani to hold their political rallies as he contested the House of Representatives against the PDP member, and won at the court of appeal.” Desmond Adewale alleged
